This Privacy Policy describes the types of information
collected and the manner in which such information is collected
and used by Tapgad (“Tapgad”) in its role as
the developer and hosting agent for the member network website
(each, a “Partner Website”) of the Tapgad Partner
(each, a “Partner”).
The disclosure of personally identifiable information (“PII”)
is a sensitive and serious issue, and Tapgad considers it
imperative to protect the privacy of Partner Website registrants
(“Members”). Therefore, Tapgad will collect
and use PII in accordance with the terms of this Privacy
Policy and for the sole purpose of enabling you to get the
maximum benefit from the Partner Website. Please keep in
mind that PII collected from a Member will never be sold
or leased to any third party, except as set forth herein,
without the prior consent of such Member.
1. Registration
In order to register as a Member of the Partner Website,
you must provide certain PII such as your name, street address,
phone number, email address, credit card information, username,
and password. All such PII which you provide through the
Partner Website will be stored on Tapgad’s computers
and will be subject to this Privacy Policy. Tapgad owns
the servers that process and store PII and any messages,
images, profiles, reviews, listings, or any other content
(“Content”) that you publish, display, or otherwise
transmit directly or indirectly (“Post”) on
the Partner Website, in whatever form. Tapgad will endeavor
to use reasonable efforts and standard industry practices
to keep PII confidential and to protect it from unauthorized
use. The security measures employed by Tapgad are described
in Section 8 hereof. However, Tapgad may share PII from
the registration page with a third party to execute a specific
request made by you, as set forth in Section 4 hereof, or,
at a Partner’s request, Tapgad may share certain PII
from the registration page with such Partner. PII shared
with such Partner shall be governed by the Partner Privacy
Policy.
2. Your Profile
2.1 You will be asked to create a Member profile page (“Profile
Page”) that will enable you to be identified by others
as you use the Partner Website (“Profile”).
You have the option to customize your Profile so that Members
can learn more about you (“Customized Information”).
You will also be given an icon to use with your Profile,
which may be replaced by selecting from among our icon options
or by uploading a picture to use in place of the icon.
2.2 The PII contained in your Profile is visible to anyone
visiting your Profile Page, unless you elect to keep this
information hidden. In order to block your PII from being
visible by specific users you must choose to not display
your username and email in the “My Preferences”
section of the Partner Website. Your username and icon,
however, cannot be blocked generally and will be visible
to other users. Even if you restrict who can see some of
your PII, Members who already know your first or last name
will be able to find your username by utilizing our search
option. Any Customized Information you provide as part of
your Profile must be edited from the My Preferences section
in order to remove it from your Profile. You may block individual
Members from viewing your Profile, which will also prevent
them from finding your username from a search they conduct
by entering your first or last name.
2.3 Your e-mail address is used to identify you in our
system as a unique user, to contact you in connection with
your activities on the Partner Website (including, but not
limited to, confirmation e-mails or important news affecting
your relationship with a Partner, as well as to gather feedback
via surveys to enable us to improve our site according to
your needs), and to forward messages to you from other Members.
3. Third Parties; Advertisers
3 .1 Tapgad will not sell or lease your PII to third parties
without your explicit consent, unless required by law. We
may share your information with third parties under certain
circumstances, including:
a) if sharing your information is necessary to execute a
specific request by you (e.g., purchasing services or products
via credit card, in which case it would be necessary to
share your PII with a credit card processing company). In
these specific cases third parties will not retain, share
or store any PII except to provide the specific services
requested by you, and are bound by strict confidentiality
agreements which limit their use of such information;
b) if sharing your PII is required by law or is necessary
to respond to a subpoena, warrant or court order, or to
protect the rights of Tapgad; and
c) if you give us explicit permission to share your PII
for any reason not stated in this Privacy Policy.
3.2 Invitees who are invited by Members to join in Partner-sponsored
activities or to purchase products through the Partner Website
will be permitted to execute such transactions by using
the Partner Website. However, such non-Members will be required
to agree to the Terms of Use agreement and will be subject
to this Privacy Policy before being permitted to submit
PII through the Website in order to execute such transactions.
The PII of such Invitees will be considered and treated
in the same manner as PII of Members, and shall be subject
to the Terms of Use and Privacy Policy agreements of Partner
and Tapgad.
3.3 We may use third-party advertising companies to advertise
products or services on the Partner Website. These companies
may employ cookies and action tags (also known as single
pixel gifs or web beacons) to measure advertising effectiveness.
Any information that these third parties collect via cookies
and action tags will be completely anonymous.
3.4 Tapgad may share demographic information with advertisers,
potential Partners, or other parties on an anonymous and
aggregated basis (i.e., without telling these parties your
identity). One of the reasons that Tapgad may do this is
to increase the likelihood that our advertisers’ goods
and services will appeal to Members, so that we may target
specific ads at specific demographic groups. Our sharing
of demographic group information with advertisers is also
anonymous (i.e., we do not tell advertisers which particular
Members belong to which demographic groups), subject to
the rest of this Privacy Policy.
4. Links
You may occasionally see links on the Partner Website to
other websites, either via advertisements or other third-party
promotions or links posted by other Members. Tapgad is not
responsible for the privacy practices of other websites
you may visit through a link you found on the Partner Website.
If you provide information directly to a party other than
Partner, different privacy policies may cover those parties’
use of your information. Please review any company’s
privacy policy before disclosing your PII.
5. Cookies and Log Files
The Partner Website may use cookies and web log files to
track Member usage on an aggregate and anonymous basis.
6. Children
The Partner Website will not knowingly provide access to
the Partner Website to persons under the age of eighteen
(18). If Tapgad learns that a Member is under the age of
eighteen (18), appropriate steps will be taken to remove
the Member’s information from the database and restrict
the individual from future access to the Partner Website.
7. Security
Tapgad has implemented security measures to protect member
information from loss, misuse and alteration. We use industry-standard
practices such as encrypted storage, firewalls and password
protection systems to safeguard the confidentiality of your
PII. Specifically, passwords are encrypted and hidden from
System Administrators, and credit card information is encrypted
using industry best practices. Members will be given the
option to either store their credit card information in
order to expedite future purchases, or to select to re-input
such information with each purchase. Each of our employees
is aware of our security policies, and your information
is only available to those employees who need it to perform
their responsibilities.
8. You Have Control Over Your Personal Information
The success of the Partner Website is directly related to
your trust in our privacy practices. Although we encourage
our Members to share information to get the most benefit
from the Partner Website, we also let you control the way
certain PII is displayed on the Partner Website. Although
we provide powerful tools for you to share information,
remember it is always your choice whether or not to share
certain information with other Members or the general public.
You can change your PII stored on the Partner Website at
any time, whether it be the information supplied at registration
(with the exception of your username), as part of your Profile,
or anything else. You may change information in the “My
Profile” and “My Preferences” areas.
9. Changes to this Privacy Policy
Tapgad may update this Privacy Policy at any time. The latest
version of the Privacy Policy will always be available here.
